Ex Parte Child Custody
The “ex parte” process allows for a hearing to be held within 24 hours of giving notice to the other party. An ex parte request is made when an issue cannot wait until the normally required time.
The court can make an ex parte order for child custody in limited circumstances. The party requesting an ex parte order must demonstrate that failure to grant the ex parte order would result in immediate harm to the child or that there is a danger that the child will be removed from California.
